Users must read and accept this Service Agreement before signing up.

Binding Agreement. By registering for an account, participating in any pool, or accessing any services offered on the 33FootballPool.com you are agreeing to be bound by the most current version of this Agreement. All user account are governed by this Agreement.

1.   Revisions to Agreement. If we revise this Agreement, such revision will be effective five (5) days after we post the new Agreement on 33FootballPool.com. You agree to review the Agreement periodically to become aware of such revisions. You can view the Agreement at any time by clicking on the Terms and Conditions link at the bottom of the 33FootballPool.com home page. Your continued use of the Service five (5) days after a revised Agreement is posted on 33FootballPool.com will mean that you accept all such revisions. If you don't agree to the changes, or to any of the terms in this Agreement, your only remedy is not to use 33FootballPool.com and to cancel your Account. This Agreement cannot be modified on an individual basis by any person affiliated, or claiming affiliation, with the Service. If any portion of this Agreement is deemed void or unenforceable, then that provision is to be deemed severable from this Agreement and will not affect the validity and enforceability of the remaining provisions.

2.   User Account. User Accounts are free, and you may take part in all of the 33FootballPool.com pools.

1. Registration. You must provide the following information to register for a User Account:

1. Email address
2. Screen Name
3. Password
4. Location (City/state)
5. Age and Gender

2. Eligibility. To have a user Account, you must:

1. Be at least 18 years old
2. Be the individual who is assigned to the e-mail address submitted on your account registration form;
3. Be physically located in a location that does not place restrictions on your participation.
4. At all times abide by this Agreement.
1. Taxes. If your prize of 33FootballPool.com is subject to taxes it will be your responsibility to pay such taxes and provide 33FootballPool.com with tax information before prize will be given out.

3.      Limitations on Accounts. You may not open more than one Account, and 33FootballPool.com may monitor any effort to establish multiple accounts. If  discovers that you have opened more than one Account, then your Accounts will be closed without notice and 33FootballPool.com will terminate all of your Accounts. 33FootballPool.com may void any winnings won during a time during which you had multiple Accounts. Legal action may be taken.

4.   Accounts for Individual Use Only. You, as the holder of your Account, are solely responsible for all obligations and, assuming your compliance with this Agreement, are entitled to receive all the benefits as well. You may not allow any other person to access your Account, access the pools, accept any winnings, or participate in any pools using your Account. Your Account is not transferable to any other person. You agree to indemnify, defend, and hold 33FootballPool.com harmless from or for any claims, liability, damages, and/or costs (including attorneys' fees) arising from any use of your Account by any person.

5.       Cancellation and Termination.

1. Cancel at Any Time. You have the right to terminate or cancel your Account at any time during the Support Hours email jharper@spicenet.net with your request.
2. Cancellation is Sole Remedy. You understand and agree that the cancellation of your Account is your sole right and remedy with respect to any dispute with 33FootballPool.com. This includes, but is not limited to, any dispute related to, or arising out of: (1) any terms of this Agreement or 33FootballPool.com enforcement or application of this Agreement; (2) the content or services available through the Site; (3) your ability to access or use the Account; or (4) the amount of applicable taxes due.
3. How to Cancel. You may cancel your Account by emailing jharper@spicenet.net during our Support Hours (currently 9am-5pm Pacific Time Monday-Friday).
4. No Refunds. Unless 33FootballPool.com cancels your Account without any reason, if your Account is terminated, suspended, or canceled, no refund will be granted, and you will have no further access to your Account or anything within 33FootballPool.com associated with it (such as electronic messages, coupons special offers. Active Account holders may not allow former Account holders whose Account was terminated by 33FootballPool.com to use their Accounts. Any Accounts with unresolved issues with 33FootballPool.com must be settled before 33FootballPool.com will allow you to register again or win prizes.

6.   Pool Rules.

1. 33FootballPool.com Pools are not Gambling. JeffOfficePools is not a gambling site -- you are never asked to risk money on a pool at anytime There is no purchase necessary to participate in any the pools available on 33FootballPool.com. See Section 2 for an alternative mail-in means of entry in 33FootballPool.com. The pools are void if prohibited by the law in the jurisdiction in which you are playing. You are subject to all laws of the State or province and country in which you reside and from which you access 33FootballPool.com and you are solely responsible for obeying those laws. You agree that 33FootballPool.com cannot be held liable if laws applicable to you restrict or prohibit your participation. 33FootballPool.com makes no representations or warranties, implicit or explicit, as to your legal right to participate in any pools offered at 33FootballPool.com, and no person affiliated, or claiming affiliation, with 33FootballPool.com has authority to make any such representations or warranties.
2. Winner Notification and Verification.
3. Notification. Winners of prize pools will be notified by email, and arrangements will be made to pick up prize. 33FootballPool.com is not responsible for late, lost, or misdirected email notifications.
4. Verification. Winners will be required to agree in writing to an Affidavit of Eligibility and to provide their full name, address, city, state, postal code, Social Security Number (or other acceptable tax identification number) and date of birth (you must be 18 on the date in which you played a pool), and, where lawful, a Liability and Publicity Release within seven (7) days of notification, or winner's prize may be forfeited.
5. No Purchase Necessary. E Mail-In Entry. There is no entry fee requirement to participate in any 33FootballPool.com’s Pools, The following is an alternative means of entry for obtaining a square in 33FootballPool.com.

12. 33FootballPool.com will enter registered users within 10 days
13. Taxes. In compliance with United States Internal Revenue Service regulations, any person who wins prizes of more than $600.00 (USD) non-cash prizes at 33FootballPool.com in any given calendar year must complete an affidavit of eligibility that includes an IRS Form W-9. 33FootballPool.com will supply an IRS Form 1099 or other appropriate form to such person and the Internal Revenue Service reporting such winnings.  Depending on the jurisdiction in which you reside, 33FootballPool.com may also send you additional similar tax forms. You remain solely responsible for paying all federal and other taxes in accordance with the laws that apply in your state, province, and/or country of residence.
14. Unclaimed Prizes will not be Awarded. Return of any prize or prize notification as undeliverable may result in forfeiture of the prize. If a Prize is not claimed, or if the winner is ineligible or does not provide eligibility verification, then the prize will not be awarded.
15. Chances of Winning. The chances of winning a prize will depend on the number of entries in the particular pool.
16.  List of Winners. A list of recent winners is available upon request to 33FootballPool.com.

2. Be a new and unique customer to 33FootballPool.com,
3. Over the age of 18,
4. Be located in a valid state,
5. Not be registered with 33FootballPool.com under any other name or alias,
6. Have submitted a valid email address,
7. Have submitted their full legal First and Last Name,
8. Have submitted a complete valid City and State, and
9. Have accepted the 33FootballPool.com Terms & Conditions and continues to play within the regulations of the Terms & Conditions as they may be modified.
10. 33FootballPool.com reserves the right to determine at its sole discretion whether a user is a "Valid Person".
11. Promotion and Special Offers Rules. 33FootballPool.com conducts many promotions and special offers. Each promotion or special offer is governed in general by these Terms and Conditions. In addition, each promotion or special offer may have a unique set of Rules that dictates entry requirements, prizes, schedule, etc. Therefore, each promotion or special offer is conducted in conjunction with these Terms and Conditions and its set of Rules together. It is each member’s responsibility to review these Terms and Conditions from time to time, and to review each promotion or special offer set of Rules before participating.
12. Limitation of Liability. YOU AGREE THAT 33FootballPool.com IS NOT RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM USE, ACCESS, OR ATTEMPTED USE OR ACCESS OF THE SERVICE. YOU FURTHER AGREE THAT 33FootballPool.com IS NOT LIABLE FOR ANY DAMAGE, LOSS, OR INJURY CAUSED BY DOWNLOADING ANY INFORMATION FROM THE SERVICE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU AGREE THAT 33FootballPool.com IS NOT LIABLE FOR ANY DAMAGE TO YOUR PERSONAL COMPUTER, ANY DAMAGE, LOSS, OR CORRUPTION OF DATA, OR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING FROM USE OF THE SERVICE.
13. Termination of Service. You agree that 33FootballPool.com, in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content within the Service, for any reason, including, without limitation, if 33FootballPool.com believes that you have acted inconsistently with the letter or spirit of these Terms and Conditions. Further, you agree that 33FootballPool.com shall not be liable to you or any third-party for any termination of your access to the Service. Further, you agree not to attempt to use the Service after said termination.
14. No Warranty. ALL GOODS AND SERVICES PROVIDED ON THE SITE ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NO PERSON AFFILIATED, OR CLAIMING AFFILIATION, WITH THE SITE HAS AUTHORITY TO EXTEND SUCH WARRANTIES.
